1. Acceptance of Terms
By accessing or using FixReminder ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
FixReminder is a property maintenance scheduling and reminder service designed for landlords and property managers. The Service allows users to track maintenance tasks, receive reminders, and manage rental properties.
3. User Accounts
To use certain features of the Service, you must create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account
4. Subscription and Payments
Some features of the Service require a paid subscription. By subscribing to a paid plan:
- You agree to pay all applicable fees
- Subscriptions automatically renew unless cancelled
- Refunds are handled on a case-by-case basis
- We reserve the right to change pricing with 30 days notice
5. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose
- Attempt to gain unauthorized access to the Service
- Interfere with or disrupt the Service
- Upload malicious code or content
- Resell or redistribute the Service without permission
6. SMS Notifications (Pro-20+ Plans)
SMS notifications are an optional feature and are not required to use FixReminder. By separately opting in to SMS notifications through the checkbox in your Account Settings:
- You consent to receive SMS reminders from FixReminder about upcoming and overdue maintenance tasks
- You will receive approximately 1-10 messages per month, depending on your maintenance schedule
- Message and data rates may apply based on your mobile carrier's plan
- Message frequency varies based on the number of properties, units, and tasks you manage
- You can opt out at any time by replying STOP to any message or by removing your phone number in Settings
- For help, reply HELP to any message or contact our support team
- Supported carriers include major US carriers; check with your carrier for compatibility
- We use Twilio to deliver SMS messages and are not responsible for carrier delays or failures
- Your mobile number and SMS consent will not be shared with or sold to third parties or affiliates for marketing or promotional purposes
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy.
8. Intellectual Property
The Service and its original content, features, and functionality are owned by FixReminder and are protected by international copyright, trademark, and other intellectual property laws.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIXREMINDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.
11. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.
